Group Terms

These Group Terms are an agreement between NextName, Inc., an Illinois corporation (“NextName”), and each club, alumni organization, fan group, or other organization (the “Organization”) that operates a verified official group on the NextName platform (a “Group”). By creating or claiming a Group, or by designating or acting as a Group Owner or Organizer, the Organization accepts these Group Terms.
1. What these terms cover. How Groups are set up, run, and closed. Individual members who join a Group use NextName under NextName’s Terms of Service (nextname.io/terms) and Privacy Policy (nextname.io/privacy), which these Group Terms supplement and do not replace. If these Group Terms and the Terms of Service conflict with respect to an individual’s use of the platform, the Terms of Service control.
2. The Group and its Owners and Organizers. The Organization designates one or more of its officers or volunteers as the Group’s owners and organizers (its “Owners” and “Organizers”). They control the Group: they approve content before it is visible to Group members, manage the Group’s events, and may add or remove Owners and Organizers as the Organization’s leadership changes. The Organization is responsible for the actions its Owners and Organizers take in the Group.
3. What NextName provides. Setup support for new Groups (including loading the Organization’s event calendar at onboarding), hosting, the platform’s group, event, and RSVP tools as they exist from time to time, and reasonable support for Owners and Organizers. It is free: NextName charges the Organization no fees, and members need no payment method to join or RSVP.
4. What the Organization provides. Accurate event and organization information, at least one active Owner, and reasonable cooperation in setting up the Group. The Organization runs its own events; NextName provides software, not event staffing, venues, security, or insurance, and is not the host, organizer, or sponsor of the Organization’s events.
5. Names and logos. Each side keeps what it owns. The Organization grants NextName a limited, revocable license to display the Organization’s name and logo within the Group and where the Group appears in the platform, for as long as the Group operates. NextName grants the Organization a limited, revocable license to use NextName’s name and logo to announce and describe the Group to its community. Neither side may use the other’s marks in any other way, including in advertising or press, without written permission. Nothing in these Group Terms grants either side any rights in any school, university, or other third-party marks.
6. What the Organization receives, and the data rules. The Organization sees what members do in its Group: the member’s display name and profile image, their role in the Group, and their participation — RSVPs, attendance and turnout, posts, and engagement.
NextName does not give the Organization members’ contact information. The Organization receives no member email addresses, phone numbers, or mailing addresses, and no personal data about a member beyond what is described above.
NextName may later offer members a way to share their name and email address with the Organization so it can contact them directly. If it does, that will be a separate and optional choice each member makes for themselves — a member will be able to join and take part in a Group without sharing contact information, will be able to withdraw the choice afterwards, and the Organization will receive contact information only for those members who have chosen to share it. NextName will describe that sharing in its Privacy Policy before it operates, and the Organization will be told when it becomes available. Until then, no such sharing occurs.
If the Organization ever receives member contact information, it may use it only to communicate with its own members about the Organization, the Group, and its activities, and may not sell it or share it outside the Organization. NextName does not sell members’ personal information, to the Organization or to anyone else. Anything the Organization sees traces back to what members chose to do in the Group. NextName’s handling of all personal data is governed by its Privacy Policy.
7. Closing a Group. The Organization may close its Group at any time by telling NextName (email is fine) or through the platform where available. NextName may suspend or close a Group for a violation of these Group Terms or the Terms of Service. When a Group closes, members keep their accounts, and data is handled per the Terms of Service and Privacy Policy.
8. Changes to these terms. NextName may update these Group Terms. Material changes will be announced to Group Owners and Organizers at least 14 days before they take effect. Continuing to operate a Group after a change takes effect is acceptance of the updated terms.
9. The fine print. These Group Terms create no partnership, joint venture, agency, or exclusivity: the Organization may use any other tools, and NextName may work with any other organization. Neither side owes the other any payment under these Group Terms. THE PLATFORM IS PROVIDED “AS IS”; NextName’s warranty disclaimers and limitations of liability in the Terms of Service apply to these Group Terms, and neither side is liable to the other for indirect or consequential damages. These Group Terms are governed by the laws of the State of Illinois, and any dispute arising out of or relating to them will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Chicago, Illinois.
